This legal notice governs access to and use of the website corkvalley.es and its subdomains, including reservas.corkvalley.es and catalogo.corkvalley.es (hereinafter, “the Website”).
2. Conditions of use
Access to the Website is free of charge and confers the status of user, which implies full acceptance of the conditions set out in this legal notice from the moment of access.
The user undertakes to make diligent use of the Website and of the services accessible through it, in accordance with the law, good faith and public order. In particular, the user shall refrain from:
- Using the Website for unlawful purposes or purposes harmful to the rights and interests of third parties.
- Introducing or spreading programs or data liable to damage the computer systems of the owner or of third parties.
- Attempting to access restricted areas, circumvent security measures or reverse engineer the Website’s software.
- Systematically extracting, reproducing or reusing the contents of the Website by means of automated tools.
- Providing false data, or third-party data without their authorisation, in the forms and booking processes.
2.1. Adults-only accommodation (minimum age 16)
Cork Valley is an adults-onlyestablishment. The minimum age to stay is 16; guests below that age are not admitted. Guests aged 16 and 17 must be accompanied throughout the stay by an adult who takes responsibility for them.
Contracting services through the Website is reserved in all cases for persons over 18 with full legal capacity to contract. When making a booking, the user declares that they are of legal age and assumes responsibility for the companions included in it. The owner does not direct its services at minors and does not knowingly collect their personal data without the involvement of a responsible adult.
3. Intellectual and industrial property
All the contents of the Website — texts, photographs, videos, graphics, images, design, icons, trade marks, trade names, logos, source code and navigation structure — belong to Cork Valley Management, S.L.U. or to third parties who have authorised their use, and are protected by Spanish and international intellectual and industrial property law.
Their reproduction, distribution, public communication, transformation or any other form of exploitation, in whole or in part, is prohibited without the prior written authorisation of the owner. Access to the Website does not grant the user any right over those contents.
Photographs of the accommodation and its surroundings are illustrative and may not reflect the exact state of the facilities at the time of the stay.
4. Electronic contracting and booking process
Bookings are made through the booking engine integrated into the Website, operated by Mews Systems B.V. The process consists of the following stages:
- Selecting dates and number of people.
- Selecting the accommodation category (Timber Cabin or Mirror House) and rate.
- Entering the booking holder’s details and payment details.
- Checking and confirming the booking.
- Receiving confirmation by email, at which point the contract is deemed to be concluded.
The contract is formalised in Spanish. The prices shown are expressed in euros and include applicable taxes, unless expressly stated otherwise. The particular conditions of each rate, including cancellation and modification conditions, are shown before the booking is confirmed and form part of the contract.
4.1. Right of withdrawal
In accordance with article 103.l) of Spanish Royal Legislative Decree 1/2007, of 16 November, approving the consolidated text of the General Law for the Defence of Consumers and Users, the right of withdrawal does not apply to contracts for accommodation services for purposes other than residential where a specific date or period of performance is provided for. The cancellation conditions of the contracted rate apply instead.
5. Exclusion of liability
The owner does not guarantee the availability and uninterrupted continuity of the operation of the Website, nor the absence of errors in its contents, although it will make reasonable efforts to avoid and correct them.
The owner shall not be liable for damage arising from:
- Interruptions, viruses, faults or disconnections in the user’s operating system or equipment.
- Delays or blockages caused by deficiencies or overloads in telecommunications networks.
- Improper use of the Website by users.
- The actions of third parties who breach the security measures in place.
6. Links to third-party sites
The Website may contain links to third-party sites. Those links are provided for information purposes only. The owner does not have the human or technical means to know, control or approve in advance the information hosted on those sites, and assumes no liability for their contents, services or privacy policies.
The establishment of a link to the Website does not imply any relationship, collaboration or supervision between the owner and the party responsible for the linking site.
7. Data protection and cookies
The processing of personal data collected through the Website is governed by the Privacy Policy. The use of cookies and similar technologies is governed by the Cookie Policy. Both documents form an integral part of this legal notice.
8. Amendments
The owner reserves the right to modify at any time the presentation, configuration and contents of the Website, as well as this legal notice. Amendments take effect from their publication.
9. Applicable law and jurisdiction
This legal notice is governed by Spanish law.
For the resolution of any dispute arising from access to or use of the Website, the parties submit to the Courts and Tribunals of Toledo. However, where the user is a consumer resident in the European Union, the competent forum shall be the one corresponding under the applicable consumer legislation, which as a general rule is that of their domicile.
Users are also informed of the existence of the European online dispute resolution platform, available at ec.europa.eu/consumers/odr.
